Terms of Participation for CoinQuest Community Challenges

These Terms of Participation apply to all Community Challenges held on the CoinQuest platform. The CoinQuest Terms of Use and Privacy Policy apply in addition. Separate terms published for other prize draws apply to those draws.

1. Organiser

The organiser is the operator of the CoinQuest platform, currently Softwareentwicklung Stefan Träger, Lohwaldstraße 21, 94113 Tiefenbach, Germany (the „organiser“). The current details are set out in the legal notice (Impressum).

2. Subject matter of a challenge

A challenge is a time-limited competition relating to one specific country. It combines a shared community goal with an individual comparison of contributions:

  • The prize pool is only unlocked once all participants together reach the minimum score defined for the challenge (the „community goal“).
  • Once the community goal is reached, the three participants with the most confirmed challenge points receive the advertised prizes.

Title, country, period, community goal, prizes and the qualifying actions are published on the page of each challenge and form part of these terms.

Participation is free of charge and does not depend on the purchase of any goods or services. No payment or contribution in kind is required.

3. Eligibility

  • Eligible to participate are natural persons with a registered CoinQuest user account who have reached the age of 18 and are resident in the European Union, Switzerland or the United Kingdom.
  • Guest accounts do not participate.
  • The organiser, the persons involved in preparing and running the challenge and their relatives are excluded from participation.
  • Only one user account per person is eligible. Anyone using several accounts in order to spread contributions across multiple participants will be excluded under § 8.
  • Accounts with the „operator“ role receive no points for maintaining their own locations and to that extent do not take part in the competition.

4. Participation and period

No separate registration is required, nor is it possible. Participation takes place automatically as soon as an eligible user carries out a qualifying action on a catalogue entry of the relevant country within the published challenge period.

What matters for allocation to a challenge is solely the time of submission, not the time of approval. A contribution submitted in time therefore still counts even if it is only approved after the end of the challenge period. A contribution submitted after the end no longer counts.

5. Challenge points

Challenge points are not additional CoinQuest points. For the challenge, only the CoinQuest points awarded in the ordinary course are evaluated a second time. An action is therefore neither rated higher nor credited twice.

  • Only the types of action named on the challenge page count. Actions that are not relevant to the catalogue – comments, for example – may be excluded.
  • Only contributions to catalogue entries of the respective country count. The participant's place of residence or origin is irrelevant.
  • Only contributions that have passed moderation and been approved count. Contributions not yet reviewed are shown to the participant as „under review“ but feed neither into the leaderboard nor into the community progress.
  • Subsequent changes to a location which the participant submitted themselves or manages as its operator do not count. Improving one's own entry is maintenance, not a competitive contribution – and could otherwise be repeated any number of times.
  • Where no point is awarded for an action in the ordinary course, no challenge points arise either.

6. Community goal and prize pool

The prize pool is unlocked as soon as the confirmed challenge points of all participants together reach the published minimum score. The community goal may also still be reached after the end of the challenge period if contributions submitted in time are only approved afterwards.

If the community goal is not reached by the time all reviews are complete, the challenge ends without winners and without any prizes being awarded. There is no claim to a prize in that case.

7. Determining the winners and ties

The winners are only determined once the challenge period has expired, all contributions submitted in time have been conclusively reviewed and the community goal has been reached. Until then, the displayed standing is provisional.

At most three winners are determined. First place receives the first prize, second place the second and third place the third. Prizes are not shared; no additional prizes are awarded because of a tie.

Where the number of confirmed challenge points is equal, the following criteria apply in turn:

  1. the higher number of individual validated challenge actions,
  2. the earlier time of submission of the last action relevant to the final score,
  3. a reproducible draw. This does not take place at random at the moment of drawing, but by means of a fixed procedure derived from the challenge and user identifiers. The result can therefore be retraced and verified at any time.

The final result is published permanently on the page of the challenge.

8. Exclusion from participation

The organiser may exclude participants from the challenge and subsequently remove contributions already counted where good cause exists, in particular in the case of

  • the use of several accounts by the same person,
  • the submission of manifestly incorrect, invented, duplicated or meaningless catalogue data,
  • the use of automated tools or other manipulation,
  • a breach of the Terms of Use or of these Terms of Participation.

Exclusion may also take place after the prize pool has been unlocked and after a provisional interim standing has been announced. A prize already handed over may be reclaimed in that case.

9. Notification and handover of prizes

Winners are notified after the evaluation has been completed, using the email address stored in their user account. The participant is responsible for the accuracy and availability of that address.

If a winner does not come forward within four weeks of the notification being sent with the details required for the handover, the claim to the prize lapses. In that case the organiser is entitled, but not obliged, to offer the prize to the next-placed participant.

Prizes are not paid out in cash, not exchanged and not transferred to third parties. Vouchers are issued subject to the terms of the respective issuer; the organiser has no connection with those issuers and accepts no liability for their services.

Any taxes and duties payable on the prize are borne by the winner.

10. Amendment and early termination

The organiser reserves the right to amend, interrupt or terminate a challenge early, in whole or in part, for good cause, in particular where proper performance cannot be ensured for technical or legal reasons. Claims to a prize that have already arisen remain unaffected. Any amendment will be announced on the page of the challenge.

11. Liability

The organiser is liable without limitation for intent and gross negligence as well as for damage arising from injury to life, body or health and under the German Product Liability Act. In the case of slightly negligent breach of an obligation whose fulfilment is essential to the proper conduct of the challenge and on whose observance the participant may regularly rely, liability is limited to the foreseeable damage typical of this type of agreement. Liability is otherwise excluded.

No liability is accepted for disruptions of technical infrastructure outside the organiser's sphere of responsibility. There is no claim to uninterrupted availability of the platform.

12. Data protection

In order to run the challenge, the organiser processes the user account identifier, the displayed user name, the contributions counted within the challenge together with their time and score, and the resulting total. The legal basis is Art. 6(1)(b) GDPR (performance of the participation relationship).

User name, ranking and score are shown in the publicly visible leaderboard and in the permanently published final result. Anyone who does not want this does not take part; participation without that display is not possible.

If a participant wins, the email address and the details required for handing over the prize are processed in addition. That data is deleted once the matter has been settled, unless statutory retention obligations apply.

Further information, in particular on storage periods, recipients and the rights of data subjects, is set out in the Privacy Policy.

13. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the participant has their habitual residence remain unaffected.

Should any provision of these Terms of Participation be or become invalid, the validity of the remaining provisions remains unaffected.

The organiser is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
